Terms of service
1. Who this is between
These terms are the agreement between Labourix and the company that opens an account. The person who signs up confirms they may bind that company. Labourix is a business-to-business service; it is not aimed at consumers.
2. The subscription
- Plans and prices are on the pricing page. All prices are per month and exclusive of VAT.
- You pay a flat base fee plus a fee per active worker.
- An "active worker" is a worker who registers at least one clock-in, one hour line, or one document in a given calendar month. Someone you have created but who does no work that month is not billed. You are never charged for archived or inactive people.
- Billing runs monthly in advance for the base fee; the per-worker fee is settled for the month just ended, so you only ever pay for people who actually worked.
- We may change prices, but never for a period you have already paid, and we will give at least 30 days' notice by e-mail.
3. Cancelling
You can cancel at any time from your account. The subscription then runs to the end of the month you have already paid for, and is not renewed. We do not charge a cancellation fee and we do not require notice periods. Before you go, export your data — see the next section.
4. Your data stays yours
- Everything you put into Labourix remains your company's property. We claim no ownership of it.
- You can export your hours, documents, projects and invoices at any time while your account is active.
- We process worker data only as your processor, under the Data Processing Agreement, which forms part of these terms.
- We do not sell your data, and we do not use it to train AI models.
- After cancellation we delete or anonymise your data within 90 days, except what we must legally retain. See the privacy policy.
5. What you agree to do
- Give accurate information, and keep your workers' data accurate.
- Tell your workers that you use Labourix and what it records — including that a GPS position is captured at clock-in and clock-out. You are the controller of that data; the duty to inform is yours. We give you the wording to do it.
- Keep your login credentials safe, and not share one account between people who should have their own.
- Not misuse the service: no unlawful content, no attempt to break into other tenants, no reselling the service as your own without a written agreement.
6. What we agree to do
- Keep the service available, aiming at 99.5% monthly uptime outside announced maintenance. Maintenance is announced in advance and scheduled outside Belgian working hours wherever possible.
- Keep your data on EU infrastructure, encrypted in transit, isolated per tenant.
- Take backups and be able to restore them.
- Warn you before a document expires or a legal deadline is missed, where the feature you use provides that.
7. Compliance stays your responsibility
8. Liability
We are liable for damage caused by our own intent or gross negligence, and for anything the law does not allow us to limit. Beyond that, our total liability in any twelve-month period is limited to the fees you paid us in that period. We are not liable for indirect or consequential loss, such as lost profit, lost contracts, or fines imposed on you by an authority — including where a declaration was late or wrong because of information you entered, or because you did not act on a warning the system gave you.
9. Suspension
We may suspend an account for non-payment after reminding you, or immediately if it is being used to attack the platform or break the law. We will always tell you why, and you will always be able to get your data out.
10. Changes to these terms
If we change these terms materially we will tell you at least 30 days in advance. If you do not accept the change, you may cancel before it takes effect, and we will refund any period you paid for but will not use.
11. Law and courts
Belgian law applies. Disputes go to the competent courts of Belgium. Before going to court, write to us — most things are a misunderstanding and get solved in a day.
